These Terms of Service ("Terms") govern your use of Colloquial (the "App"), built and operated by ELLIS, Felix Adrian Raymond ("we," "us," "the developer"), an individual based in Hong Kong. By creating an account or using the App, you agree to these Terms. If you don't agree, don't use the App.
Colloquial is a language-flashcard app centred on one mechanic: you record your own audio flashcards, and at times you schedule, your phone rings like an incoming call — a real system-level call interface (Apple CallKit on iOS, Android's ConnectionService on Android), not a push notification dressed up to look like one. You answer it, and it walks you through your due flashcards by voice.
This is not a telephony service. Colloquial cannot place or receive real phone calls, cannot be used to contact anyone else, and the "call" you receive is generated entirely by the app to trigger your own practice session. You can turn this off at any time in Settings and use the app's manual, non-call practice mode instead — nothing about your account is degraded if you do.
You must be at least 13 years old to use Colloquial. By signing up, you confirm you meet this requirement. We rely on your own confirmation at sign-up rather than independently verifying your age — see the Privacy Policy for details on what that means for how we handle age.
You're responsible for keeping your account credentials secure and for anything that happens under your account. Tell us immediately at help@getcolloquial.com if you suspect unauthorized access. Authentication is handled by our provider, Supabase — see the Privacy Policy for details.
The audio and text you create in Colloquial — your flashcards — belongs to you. We don't claim ownership of it.
To make the app work, you grant us a limited licence to store, process, and play your content back to you as part of operating the service (for example, generating a temporary signed link so your own device can play your own audio). We do not use your content for anything beyond that: not for training any model, not for display to other users, not for any purpose other than serving the app back to you.
You're responsible for what you record. Don't use Colloquial to store or transmit content that's illegal, infringes someone else's rights, or that you don't have the right to record and keep. We reserve the right to remove content or suspend accounts that violate this, though as a small, solo-operated app, we're not proactively monitoring content — we act on reports and clear violations, not on routine surveillance of what you record for your own study.

Colloquial is free. There are no subscriptions, no in-app purchases, and no payment of any kind collected through the app. An optional in-app "notify me" signup exists for users who want to hear about future product plans — it shows no price, requests no payment information, and commits you to nothing.
Colloquial relies on infrastructure from Supabase, Cloudflare, Fly.io, PostHog, Sentry, and Resend to operate (see the Privacy Policy for what each handles), and is distributed through Apple's App Store and Google Play, both of which have their own terms that also apply to your use of the app on those platforms. We're not responsible for those third parties' own outages or policies, though we choose providers we trust and monitor them for issues affecting you.
The Colloquial name, logo, and app design belong to the developer. These Terms don't grant you any rights to our brand, trademarks, or the app's underlying code, beyond the licence to use the app itself as intended.
Colloquial is provided "as is." We work to keep it reliable, but we don't guarantee it will be uninterrupted, error-free, or available at all times — this is a solo-operated app, not an enterprise service with guaranteed uptime. We make no claim that using Colloquial will result in any particular language-learning outcome; it's a study tool, not a guarantee of fluency or any specific result.
To the fullest extent permitted by law, the developer is not liable for any indirect, incidental, or consequential damages arising from your use of (or inability to use) Colloquial, including loss of data, though we work hard to prevent that outcome specifically (see the Privacy Policy's account-deletion and data-handling sections). Nothing in these Terms limits liability that cannot legally be limited in your jurisdiction.
You can stop using Colloquial and delete your account at any time from within the app — this permanently deletes your data as described in the Privacy Policy. We may suspend or terminate your access if you materially violate these Terms, or discontinue the app entirely with reasonable notice if we're no longer able to operate it — in that case, we'll give you the ability to export your data first.
If we make a material change to these Terms, we'll update the date above and notify you in the app before the change takes effect for your account.
These Terms are governed by the laws of Hong Kong SAR. If you live in the EU, EEA, UK, or another jurisdiction whose law gives you consumer or data-protection rights that can't be signed away by agreement, this governing-law choice doesn't take those rights away from you.
